Kamax Inc\, holding FCA’s use of the phrase “approximately 65%-100% of FCA’s requirements” satisfies the Michigan UCC’s quantity term requirement. The upcoming decision by the Michigan Supreme Court is expected to resolve some of the remaining tension between the Michigan Supreme Court’s earlier decision in MSSC\, Inc v. Airboss Flexible Prods Co (2023) and the Court of Appeals’ decision in Cadillac Rubber & Plastics\, Inc v. Tubular Metal Systems\, LLC (2020).
